Welcome to InclusiCare, a web-based application operated by InclusiGear ("we," "us," or "our"). InclusiCare is designed to help caregivers document, organize, and share information related to the care of children and dependents, particularly those who are neurodivergent.
By creating an account, accessing, or using the InclusiCare application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
1. Purpose of the Service
InclusiCare provides tools that allow users to:
- Create and manage profiles for children or dependents.
- Record daily insights, wellness metrics, and care-related information.
- Log events such as behaviors, eating, toileting, stress events, and caregiver responses.
- Invite trusted caregivers, family members, or professionals to collaborate via a "Care Circle."
- Receive AI-assisted suggestions and pattern recognition based on entered data.

2. User Responsibilities and Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials (username and password).
- All activities that occur under your account.
- The accuracy, quality, and legality of the information you enter into the Service.
- Deciding who you invite to access child profiles and ensuring they are authorized to view such sensitive information.
- How the information and AI-generated insights are used in real-world care decisions.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3. HIPAA Compliance and Protected Health Information (PHI)
We recognize that the information you store in InclusiCare may include Protected Health Information (PHI) as defined by the Health Insurance Portability and Accountability Act (HIPAA). We are committed to maintaining the privacy and security of your PHI.
- Security Measures: We implement administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the electronic PHI that we create, receive, maintain, or transmit.
- Business Associate Agreement (BAA): If you are a Covered Entity under HIPAA using InclusiCare in a professional capacity, your use of the Service is governed by our standard Business Associate Agreement, which is incorporated into these Terms by reference.
- Consumer Use: If you are using InclusiCare as a parent or personal caregiver, while HIPAA may not strictly apply to you as a Covered Entity, we still apply HIPAA-aligned security standards to protect your data.

4. AI-Assisted Features Disclaimer
InclusiCare includes AI-assisted features (such as "CARLA") designed to surface patterns, summarize notes, and provide suggestions based on user-entered data.
You understand and agree that:
- AI-generated suggestions are informational only and are based solely on the data provided.
- They are not medical, therapeutic, or clinical recommendations.
- They should not replace professional judgment, guidance, or common sense.
- We do not guarantee the accuracy, completeness, or usefulness of any AI-generated insights.
5. Data Ownership and Usage
- Your Data: You retain all rights, title, and interest in and to the data you enter into InclusiCare.
- Our Use: You grant us a limited, non-exclusive license to use, process, and store your data solely for the purpose of providing and improving the Service.
- No Selling of Data: We do not sell your personal data or PHI to third parties. We do not use your data for advertising purposes.
- Anonymized Data: We may aggregate and anonymize data (removing all personally identifiable information and PHI) to improve our AI models, conduct research, and enhance the Service.
6. Feedback and Communication Consent
By creating an account, you agree that InclusiGear may contact you:
- To provide essential service updates and security notices.
- To request feedback or conduct usability research to improve InclusiCare.
You may opt out of non-essential, feedback-related communications at any time by adjusting your account preferences or contacting us directly. Opting out will not affect your ability to use the app.
7. Limitation of Liability
InclusiCare is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
To the fullest extent permitted by law:
- InclusiGear, its affiliates, and its employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
- We are not liable for any interruptions in service, system failures, or unauthorized access to our servers.
- We are not responsible for damages resulting from reliance on information entered into or generated by the app.
- Users assume all risk associated with using the service for care management.
8. Service Availability and Modifications
We reserve the right to:
- Modify, update, or discontinue features of the Service.
- Temporarily suspend access for maintenance or updates.
We will make reasonable efforts to communicate significant changes or scheduled downtime but are not obligated to maintain uninterrupted service.
9. Account Termination
- By You: You may discontinue use of InclusiCare and delete your account at any time through the application settings.
- By Us: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms, misuse the service, or engage in illegal activities.
Upon termination, your right to use the Service will immediately cease. We will retain and delete your data in accordance with our Privacy Policy and applicable laws.

We may update these Terms periodically to reflect changes in our practices, technology, or legal requirements.
